Limits of Association Action (Policy #3)
Based on common sense and the advice of several governmental authorities, the Association was advised not to try to enforce any problems falling under the jurisdiction of a higher authority. While it is not possible to anticipate every circumstance, the Directors hereby set forth some of the more common situations they will and will not attempt to mediate or enforce.
The Association is not the authority for dealing with:
- Outdoor fire nuisance or damage
- Property line disputes
- Discharge of firearms[D W1]
- Animal or insect pest control
- Utility issues (electricity, water*, cable TV)
- Insurance (note especially that boats moored at common docks are not insured under any of the Association’s policies)
- Speeding**
- Noise pollution
- Reckless watercraft operation
Authorities could be one or several of the following: Franklin County Administrator/Building Inspector/Clerk of Court/Sheriff/Board of Supervisors/Animal Control Officer, State Police, VDOT, AEP, Corps of Engineers, DGIF, DEQ, FERC, Charter Communications, CF&O, your insurance agent. Please contact them yourself.
* We do try to keep our eye out for piping leaks or overflowing of the water tank. Please contact Smith Mountain Lake Water Company at 888 373 8787or David Weiler at 576-3209 if you notice such problems.
** The posted speed limit of 25 mph should be observed.
The Association does deal with things covered in the Declarations of Restriction, and the Amendments thereto, the Bylaws and Amendments thereto, the Rules and Regulations, and the Policy Statements. This includes:
- Soil erosion problems (in conjunction with Franklin County Building Inspectors Office)
- Building approvals
- Lawn and lot upkeep
- Trespass by outsiders on common areas and common docks
- Unauthorized use of common docks *
- Dues delinquencies
*The Common Docks (slips and walkways) are for the use of Members and Guests visiting the Members only. Permission to use a slip belonging to the owner of an off-water lot must be sought beforehand.
